A slip and fall can occur practically anywhere and are often much more serious than you would think. These types of accidents can happen to people of all ages and are typically caused by conditions such as wet floors, uneven surfaces, and poor lighting. Should you sustain an injury due to a slip and fall incident, keep the following tips in mind.

In Florida, a slip and fall case requires the following…

  • A Dangerous Condition: The property where the incident occurred has a dangerous or unsafe condition present.

  • The Owner’s Knowledge: The property owner had knowledge of the condition, or should have known about it.

  • Failure to Fix or Warn Others: The property owner failed to address or warn visitors about the issue within a reasonable amount of time.

  • Causation: The property owner’s negligence led to the injury.

  • Damages: The fall resulted in damages, which could include medical bills, lost wages, or pain and suffering.

Immediately after a fall, don’t forget to…

  • Seek Medical Attention: Documentation is key, even if you don’t feel injured right away.

  • Report the Incident: Notify the property owner or manager, and then request a copy of the report.

  • Document the Scene: Take photos and video of the property, including what caused the fall and the surrounding area.

  • Get Witness Information: If possible, try to gather names and contact information from individuals who witnessed the fall.

  • Save Clothing and Footwear: Preserve the items worn when the incident occurred, as they could potentially become evidence.

  • Do Not Sign Anything: Avoid signing any documents without legal advice, including items from insurance adjusters.

  • Contact and Attorney: Contact a Personal Injury Attorney as soon as possible to discuss your slip and fall.

Unfortunately, falls are among the leading causes of non-fatal injury-related hospital admissions in Florida. By acting quickly and preserving key evidence, you give yourself the best chance of holding the right party accountable.
